Family Law Mediation
Parenting plans, time-sharing, support, and property division mediation for Florida families.
What Is Family Mediation?
Family mediation is a process where a neutral mediator helps parents or family members work through disagreements and reach agreements on issues like parenting plans, time-sharing schedules, child support, alimony, and property division.
The mediator doesn’t make decisions for you. Instead, I facilitate conversation, help clarify interests, explore options, and guide the process toward solutions that work for your family.
Common Family Mediation Topics
- Parenting plans and time-sharing schedules
- Child support calculations and modifications
- Spousal support (alimony)
- Division of marital property and debts
- Modification of existing orders
- Relocation requests
- Post-judgment disputes
Who Can Benefit?
Family mediation is helpful for:
- Parents creating or modifying parenting plans
- Divorcing couples working through asset division and support
- Pro-se litigants navigating the court process without attorneys
- Parties with attorneys looking for a faster, less adversarial resolution
- Post-judgment disputes where circumstances have changed
The Family Mediation Process
Before the Session
Once you schedule, you’ll receive:
- Zoom joining instructions
- A preparation checklist (what to gather, what to think about)
- Information about confidentiality and the voluntary nature of mediation
- Any required forms or intake documents
During the Session
Sessions typically last 2-4 hours, though complex cases may take longer or require multiple sessions. Here’s what to expect:
- Opening: I explain the process, confidentiality, and ground rules
- Discussion: Each party shares their perspective and priorities
- Exploration: We identify issues, clarify interests, and explore options
- Negotiation: Parties work toward agreements that meet their needs
- Drafting (if needed): I can prepare a summary or memorandum of agreement
You can have your attorney present (in the Zoom call or in person with you). If you don’t have an attorney, I encourage you to consult one before finalizing any agreement.
After the Session
If you reach an agreement:
- I provide a written summary or memorandum
- You and your attorney review the terms
- Your attorney prepares the necessary court documents
- The agreement is submitted to the court for approval
If you don’t reach full agreement:
- Partial agreements are still valuable and can be documented
- You can schedule another session to continue discussions
- You return to the court process with any unresolved issues
Preparing for Family Mediation
To make the most of your session:
- Gather documents: Financial affidavits, tax returns, pay stubs, account statements, parenting schedules
- Think about priorities: What matters most to you? What are your non-negotiables?
- Consider your children’s needs: How can you support their wellbeing and stability?
- Be ready to listen: Mediation works best when both parties come ready to hear each other
- Consult your attorney: If you have one, discuss your goals and boundaries before the session
Is Family Mediation Required in Florida?
In many Florida counties, mediation is required before a final hearing in family law cases. Even when it’s not required, many parties choose mediation because it’s:
- Faster than waiting for a trial date
- Less expensive than prolonged litigation
- More flexible than a court order
- Confidential and less adversarial
- Empowering because you control the outcome
Mediation for Pro-Se Parties
If you’re representing yourself, mediation can be especially helpful. I explain the process clearly, make sure you understand your options, and create a space where you can negotiate on equal footing.
That said, mediation is not a substitute for legal advice. I cannot tell you what to do or what’s “fair.” I strongly encourage pro-se parties to consult with an attorney before finalizing any agreement, even if you don’t have representation throughout the case.
