The Circuit Civil Mediation Process
Pre-Mediation
- Parties (and their attorneys) agree on a mediation date
- I review case summaries, pleadings, or mediation statements if provided
- Zoom joining instructions and preparation materials are sent
During Mediation
Circuit civil mediations typically last 3-5 hours, though some cases resolve faster and others may require additional sessions. The process includes:
- Opening statement: Overview of the process and ground rules
- Party presentations: Each side shares their perspective
- Joint discussion: Parties and attorneys discuss the case together (if appropriate)
- Private caucuses: I meet separately with each side to explore settlement options
- Negotiation: Offers and counteroffers are exchanged, often through the mediator
- Documentation: If an agreement is reached, key terms are documented
Post-Mediation
- Settlement agreements are drafted by the parties’ attorneys
- If no settlement is reached, the case continues through the court process
- Partial settlements are documented and reduce the scope of remaining litigation
