The Circuit Civil Mediation Process

Pre-Mediation

• Parties (and their attorneys) agree on a mediation date
• I review case summaries, pleadings, or mediation statements if provided
• Zoom joining instructions and preparation materials are sent

During Mediation

Circuit civil mediations typically last 3-5 hours, though some cases resolve faster and others may require additional sessions. The process includes:

1. Opening statement: Overview of the process and ground rules
2. Party presentations: Each side shares their perspective
3. Joint discussion: Parties and attorneys discuss the case together (if appropriate)
4. Private caucuses: I meet separately with each side to explore settlement options
5. Negotiation: Offers and counteroffers are exchanged, often through the mediator
6. Documentation: If an agreement is reached, key terms are documented

Post-Mediation

• Settlement agreements are drafted by the parties’ attorneys
• If no settlement is reached, the case continues through the court process
• Partial settlements are documented and reduce the scope of remaining litigation
