Common questions about mediation in Florida, the Zoom process, costs, and what to expect.
General Mediation Questions
Mediation is a voluntary process where a neutral third party (the mediator) helps people in a dispute work toward resolution. The mediator doesn’t make decisions or give legal advice—instead, I facilitate conversation, clarify interests, and help parties explore options. You remain in control of the outcome.
In many Florida counties, mediation is required in family law cases before a final hearing. Some civil cases also require mediation. Even when it’s not required, parties often choose mediation because it’s faster, less expensive, and less adversarial than going to trial.
Yes. Florida law protects mediation confidentiality. What you say in mediation generally cannot be used in court. This allows parties to speak openly and negotiate freely. There are limited exceptions, such as discussions of child abuse or threats of violence, which I explain at the start of every session.
No. Mediation is voluntary. Even if the court orders you to attend mediation, you cannot be forced to agree to any outcome. If you don’t reach an agreement, you can return to court. My role is to facilitate the process, not to pressure you into a settlement.
Partial agreements are valuable. Even if you don’t resolve everything, narrowing the issues saves time and money in court. I can document any agreements you do reach, and you can continue to litigate the unresolved matters.
Zoom Mediation
Zoom mediation works just like in-person mediation, but everyone joins from their own location. I send you a Zoom link before the session. You join from a private space with a reliable internet connection. We can use breakout rooms for private discussions, share documents on screen, and communicate just as effectively as we would in person.
You need a device with internet access (computer, tablet, or smartphone), a webcam, and a microphone. Zoom is free to join—you don’t need an account. I recommend using a computer or tablet for easier document sharing, but a phone works too.
Yes. I use secure, password-protected Zoom settings and follow confidentiality protocols. Zoom mediation is widely accepted by Florida courts and meets security standards for legal proceedings.
I provide my phone number before every session. If you lose connection or have technical difficulties, you can call in by phone to continue. We can also reschedule if needed.
Family Mediation
Yes. You can have your attorney join the Zoom call or be physically present with you. Many parties mediate without attorneys, especially in family cases. If you don’t have an attorney, I strongly encourage you to consult one before finalizing any agreement.
Most family mediations last 2-4 hours. Some cases resolve faster; others may require multiple sessions. Complex financial or custody issues may take longer.
Bring any relevant documents: financial affidavits, tax returns, pay stubs, account statements, current parenting schedules, or proposed parenting plans. I send a preparation checklist when you schedule your session.
I can’t force anyone to agree. However, mediation often opens communication and helps parties see options they hadn’t considered. Even if you don’t reach full agreement, the process can clarify positions and narrow issues for court.
Civil Mediation
Most parties in civil litigation have attorneys. While you’re not required to have one, I strongly recommend consulting with an attorney before agreeing to any settlement, especially in personal injury or complex business cases.
I cannot advise you on what to settle for—that’s a legal decision you make with your attorney. My role is to help facilitate discussions and explore options, not to tell you what’s fair or reasonable.
